These Terms govern your use of the Elmunei Studio website. Client work is governed separately by the agreement signed for each engagement.
1. Agreement
By accessing or using elmunei.com (the "Site") you agree to these Terms of Use. If you do not agree, please do not use the Site.
2. Permitted use
You may use the Site for lawful, non-commercial informational purposes. You may not:
- Use the Site or its content to train an AI model without our prior written consent.
- Probe, scan, scrape, or attempt to access parts of the Site that are not publicly served.
- Reproduce or distribute substantial portions of the Site without our prior written consent.
- Use the Site to send spam, conduct phishing, or otherwise harm Elmunei or its visitors.
3. Project brief submissions
When you submit a project brief, you confirm that the information you provide is accurate, that you are authorised to share it, and that you consent to Elmunei processing it as described in the Privacy Policy. Submission does not create a contract or obligation on our part to provide services.
4. Intellectual property
The Site, including its name, visual identity, copy, design, and code, is the property of Elmunei Studio or its licensors. No licence is granted except the limited right to view the Site in a standard web browser.
5. Third-party links
The Site may reference third-party products, services, or trademarks. Such references are descriptive only and do not imply endorsement or partnership unless explicitly stated.
6. No warranty
The Site is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Elmunei disclaims all warranties, express or implied.
7. Limitation of liability
To the maximum extent permitted by law, Elmunei will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site.
8. Governing law
These Terms are governed by the laws of the Republic of South Africa. The courts of Cape Town have jurisdiction over disputes arising from these Terms, except where applicable consumer-protection law confers an unwaivable right to a different forum.
9. Changes
We may update these Terms from time to time. Material changes will be reflected in the "Last updated" date above.
